Freedom of speech in the USA law is a pretty complex subject and it is generally unclear for an ordinary person what it means.
Among other cherished values, the First Amendment protects freedom of speech. The U.S. Supreme Court often has struggled to determine what exactly constitutes protected speech. The following are examples of speech, both direct (words) and symbolic (actions), that the Court has decided are either entitled to First Amendment protections, or not.The First Amendment states, in relevant part, that:
“Congress shall make no law...abridging freedom of speech.”

Freedom of speech includes the right:
- Not to speak (specifically, the right not to salute the flag).
West Virginia Board of Education v. Barnette, 319 U.S. 624 (1943).- Of students to wear black armbands to school to protest a war (“Students do not shed their constitutional rights at the schoolhouse gate.”).
Tinker v. Des Moines, 393 U.S. 503 (1969).- To use certain offensive words and phrases to convey political messages.
Cohen v. California, 403 U.S. 15 (1971).- To contribute money (under certain circumstances) to political campaigns.
Buckley v. Valeo, 424 U.S. 1 (1976).- To advertise commercial products and professional services (with some restrictions).

Washington does not care who assumes power in Syria – whether it be feuding warlords or an Islamic mullah or Assad's cat. Washington knows that Islamic State needs money to survive and keep power, as does any individual or group who will rule, and that to remain in power, it will sell oil. Good enough, as far as Washington is concerned. If the place remains a seething cauldron of destabilizing hatreds, so much the better.Tim Owen, December 20, 2015 at 8:50 pmI read this carefully earlier today and wish I had made some notes.Tim Owen, December 20, 2015 at 9:08 pmIt's an interesting article just in what it says about the politics of American journalism at this point in time almost regardless of the subject matter in a kind of Kremlinology vein. It almost reads like a ransom note. My impression is that Hersh is pulling punches at some key points in order not to overplay his hand.
My suggestion: don't get bogged down in the details. From my recollection of the piece from earlier today Hersh is basically championing a few figures and – most importantly – their perspectives here:
- Michael Flynn, who led the DIA revolt against Syria policy
- Dempsey, a pragmatic cold warrior who is allergic to making the enemy into a cardboard super-villan (good enough for this Putinista)
- Patrick Lang (more below)
- and that wonderfully clear-headed Hawaiin congress-critter (can't be arsed to look her up)
It's worth remembering that Hersh's articles on the Ghoutta attack immediately predated the great stand-down by Obama from all out air-war to destroy Syria.
Given that it's axiomatic that journalists are really mouthpieces for political factions within their own government power structure and that the BEST journalists – like Hersh – actually embrace this reality, what does the appearance of this article augur?
I especially like the sign off:
"The Joint Chiefs and the DIA were constantly telling Washington's leadership of the jihadist threat in Syria, and of Turkey's support for it. The message was never listened to. Why not?"
That sounds kind of threatening. In a good way.
* Regarding Patrick Lang, I noticed that he posted a quite vehement attack against conspiracy theorists postings on his blog who were – if I recall correctly – claiming that the military were involved in the subterfuge to arm extremists in Syria. (Probably cocked up the details but too tired to check.) It struck me as noteworthy as it suggested an internecine intra-Washington struggle between Military / CIA who was going to "own" the debacle in Syria at the very least. It is utterly reminiscent of the struggle between Dulles / CIA power structure (think: institutional group think) and the incoming JFK administration / New Frontiersman during and after the Cuban Missile Crisis.
In other words: we, the west, have basically made no progress fighting for reform of our leadership and political structures. Meanwhile the Russians seem to have gone "right round the horn" – as the dinosaur in Toy Story might put it.
Of course it's worth noting that Hersh had to revert to publishing this "intimate" conversation between American power structures in a foreign publication. What does that tell you about the "freedom index"? Samizdat here we come!

Rich Ukrainian land patriots, ready day and night, not sparing the stomach, promote the masses of European values and achievements of the "revolution of dignity", the residual effects of which continue to live in tents on a Central square of the Ukrainian capital.
Solely on the principle of love of country, and most importantly loyalty to democratic ideals, formed a new composition of the National Council on television and radio broadcasting of Ukraine. First Deputy head of the organization, deciding what to watch on TV ordinary Ukrainians, Olga herasymuk, as a professional journalist, always ready to fight censorship, and freedom of speech are not just words.
Gerasimyuk no longer wants without taboos: the Patch as a new tool of freedom of speech
Olga is a true professional, she took the thorny path from the correspondent of the newspaper "Komsomolets of Poltava region" to first Deputy Chairman of the National Council of Ukraine on television and radio, and has repeatedly won the open Forum of the Russian television "azure star". In General, knows that all evil in Ukraine from Russian TV.
Everyone in the country is fine. The forces of the so-called anti-terrorist operation successfully pushed to the militia, for some reason, regularly losing manpower and equipment; Prime Minister Arseniy Yatsenyuk wants to sow the corn country and get preferences in the price of natural gas; the attorney General Vitaly Yarema confessed that the Maidan is not real. В общем, знает, что все зло в Украине от российского телевидения.
Все в стране отлично. Силы так называемой антитеррористической операции успешно теснят ополченцев, при этом почему-то регулярно теряя живую силу и технику; премьер-министр Арсений Яценюк желает засеять страну кукурузой и с ее помощью получать преференции в цене на природный газ; генпрокурор Виталий Ярема откровенничает, что майдан не настоящий. В общем, живет Украина обыденной и счастливой жизнью, размеренно и сыто, и только российская пропаганда омрачает это чудесное благоденствие.
"Нацсовет по телевидению и радиовещанию дал сутки для немедленного отключения вражеского контента тем вещателям, которые ретранслируют российскую пропаганду на Донбассе, в Луганске. Одна из причин промедления – особенно с отключением российского канала 24, который транслируется через Донецкую ОГТРК: никто не брал на себя ответственности дать команду нажать "выкл.", - озаботилась влиянием альтернативной точки зрения на события в Украине чиновница Ольга Герасимьюк.
Плюрализм в одной голове: Еще не накизделись?
Действительно, это какое-то безобразие, что находятся телекомпании, пусть даже и российские, имеющие наглость представлять убийства мирного населения и разрушение городов на Юго-Востоке Украины не как "крестовый поход" патриотичной украинской армии на логово "террористов-сепаратистов", а именно как убийства мирных граждан и разрушение городов.
Такие действия российских журналистов никак не вписываются в стройный ряд новостных сюжетов флагманов украинского телевидения. Не мудрствуя лукаво и не опровергая точку зрения оппонентов-медийщиков Российской Федерации по существу, Нацсовет по телевидению и радиовещанию решил просто-напросто запретить эту самую альтернативную точку зрения.
Если что-то не нравится или не устраивает, нужно просто сделать вид, что этого нет. Что может быть проще? Для этого нужно просто обзвонить провайдеров кабельных сетей и припугнуть их лишением лицензии за продолжение трансляции российских каналов.
"Все они сегодня обзваниваются (провайдеры – авт.), предупреждаются о лишении лицензии в случае попыток продолжения подрывной деятельности. Подключаем прокуратуру", - поведала Ольга Герасимьюк о проводимой вдумчивой работе с провайдерами.
В зоне АТО перестали выдавать паспорта
Так выглядит свобода слова по-новому и право на получение информации в исполнении самых мощных демократов за всю историю независимой Украины. Вот и прокуратуру включили в процесс, чтобы провайдеры наверняка поняли всю серьезность сделанного им предложения.
В общем, как оказалось, понимание свободы слова в сегодняшней Украине у каждого свое и трактуется исключительно с точки зрения политической целесообразности. Только вот в таком случае свобода слова плавно превращается в игру в наперстки.
Хотя какое это имеет значение в стране победившей "революции достоинства"?
"Всякое ограничение свободы печати становится средством направлять общественное мнение в пользу своих личных интересов и основывать свое господство на невежестве и всеобщей испорченности. Свободная печать - страж свободы; печать связанная - её бич", - говорил влиятельнейший политический деятель Великой Французской революции Максимилиан Робеспьер.

Коллективное мнение Национального совета по вопросам телевидения и радиовещания Украины имеет совершенно противоположную точку зрения.
По крайней мере, пока.
